  • Many TOS are just actually not legally binding.

For example, “browsewrap” in which “using this service constitutes agreement to our TOS” in which the service never actually shows you the TOS, is almost completely non-binding. This was established in Ticketmaster v. Tickets.com, 2003.

A TOS is, legally speaking, considered a contract. If the terms of service are updated and the user is not informed of it, continued consent cannot be assumed and the contract is null. This is a basic feature of contract law. This is also what prevents you from, for example, signing a lease on a home and then editing the lease after all parties have signed it to give you a monthly rental fee of $1. This annulls the new contract unless it’s re-signed.

In addition, contract law generally states that a given contract “must be intelligible to all parties”. Meaning that if the company obfuscates the TOS behind an unreasonable amount of jargon and doublespeak a judge can easily rule it as invalid if they were so inclined.

Any TOS that includes a statement about arbitration or waiving of class action rights are almost universally unenforceable because they violate consumer protection laws. This isn’t true 100% of the time, but a good lawyer will make this rule in your favor more often than it wouldn’t. If you’re bound by an arbitration clause, and you have a reasonable complaint, you can just send the company a “demand for arbitration” via your lawyer and they’ll usually have to fold.

Now, one big caveat about all this: the “subject to applicable law” line is necessary because contract law is handled differently in different areas. In the US, it is decided by state law. Naturally other countries may also have their own different implementations. I’ve done my best to make all of this research as universal as possible, but, details may be different depending on where you are located.

My primary sources for most of this were Bridge Legal and US Law Explained dot com supplemented by checking for court cases on OpenCaseBook (one was linked previously in this post). The US Law Explained source also lists a few more notable court cases at the bottom of their article that can be looked up at OCB.

  • Thinking back to theme park visits from MY childhood, I have never once in my entire life felt well secured or safe when riding a roller coaster in that style. If you’re a smaller than average person you’re pretty much entirely responsible for your own fate with those. A lot of times the bar didn’t even touch my body at all. I usually ended up clinging onto the restraint bar with my arms, to prevent myself from sliding around beneath it.

The over the shoulders style top restraint is a thousand times better and safer, in my opinion. Never had a problem with one of those.

  • Factorio enjoyer here. It’s a lot easier for me to keep my bases organized in Factorio on account of it being grid based. Satisfactory has none of that and as a result lends itself to much, much worse, 3D multi-story spaghetti.

Some people like that, some don’t. It is however a lot easier to get by with spaghetti in Satisfactory, because you can do multiple stories of crap and criss-cross and intersect your belts without issue. But if you’re a neat freak it’s difficult.

My other buddy who is a Factorio enjoyer put damn near a thousand hours into Satisfactory when he discovered it, I put maybe 20 and haven’t been back yet. But it’s a good game. It’s a titan of its genre for a good reason.

  • Yeah. I’m a guy, I was maybe 15 at the time. I was at the library, and met my buddy’s girlfriend there randomly.

I learned after the fact that she was sleeping around with a bunch of guys to prove some kind of a point, I don’t know what exactly. She was kind of generally awful.

But yeah, we spoke briefly in the library and then I took off home. She followed me home. I didn’t know this until she knocked on my door and let herself inside, and from there I was just so off-balance by the entire thing that I just went along with it. She pinned me on the couch and started kissing on me and things went from there. I put up some kind of token resistance, I think, but I barely knew what was going on, I had never had any kind of sex before, I had barely had a girlfriend before, I was in completely foreign territory and just let myself get led by the nose into something I didn’t want to do.

It caused a big, massive fight between me, her, and the buddy in question (who I was actually really close with and I got really messed up by this whole interaction) but it eventually ended up the best way it could have, where we both cut all contact with her and basically never saw her again.

But to this day I still have consent issues, especially I find it hard to initiate sex even with someone who I absolutely know is into it and wants it. I just can’t. A recent ex and I eventually broke up because I would never initiate so, we just never did it. Just the possibility of putting someone in that kind of situation just puts me completely off the mood, if I’m not the one being advanced upon, it just doesn’t happen.
